Terms and General Policies
By the use of our Domain Maintenance Services, Uploading your files to our server(s)
and/or the use of our Email services you hereby agree to the terms of our "Accepted Usage and Content" page as well as the terms set forth
in this "Terms and General Policies" page.
By using this site, you signify your Assent and Agreement to our "Accepted Usage and Content" and our "Terms and General
Policies".
Billing.
Hosted Accounts are due on the 1st of each
month. Accounts not paid by the 10th will accrue a late fee. Client will be
charged interest at the rate of 9% per annum on any balance that is not paid when due.
Accounts with an unpaid balance of more than 30 days are subject to cancellation. 30 days
notice is required to close an account and stop billing.
Hosting / DNS Setup.
The DNS registration fee covers the first
year of registration. Because the registration process can take several days (on rare
occasion’s weeks), it is possible for a submission that pre-dates your own to reserve
the domain name. For this reason, registration of your domain name is not guaranteed and
Jurgens
Information Services, Inc. cannot assume liability for cost associated with the
inability to secure a given domain name (this includes but is not limited to: stationary,
advertising materials, trademark and copyright fees, merchandise bearing the domain name,
etc). Jurgens
Information Services, Inc. is not responsible for charges from other service
providers.
Independent Contractor.
The parties agree that the relationship
created by this agreement is that of an independent contractor and not that of employer
and employee. The Consultant is responsible for the payment of any taxes, including
without limitations, all federal, state and local personal and business income taxes, use
taxes or other business taxes and license fees arising out of the activities of the
Consultant.
Liability.
The materials in this site are provided
"as is" and without warranties of any kind either express or implied. Jurgens
Information Services, Inc. disclaims all warranties, express or implied, including, but
not limited to, implied warranties of merchantability and fitness for a particular
purpose. Jurgens
Information Services, Inc. does not warrant that the functions contained
in the materials will be uninterrupted or error-free, that defects will be corrected, or
that this site or the server that makes it available are free of viruses or other harmful
components. Jurgens
Information Services, Inc. does not warrant or make any
representations regarding the use or the results of the use of the materials in this site
in terms of their correctness, accuracy, reliability, or otherwise. You (and not Jurgens
Information Services, Inc.) assume the entire cost of all necessary servicing, repair or
correction. Applicable law may not allow the exclusion of implied warranties, so the above
exclusion may not apply to you.
Under no circumstances, including,
but not limited to, negligence, shall Jurgens
Information Services, Inc. be liable
for any special or consequential damages that result from the use of, or the inability to

possibility of such damages. Applicable law may not allow the limitation or exclusion of
liability or incidental or consequential damages, so the above limitation or exclusion may

to you for all damages, losses, and causes of action (whether in contract, tort
(including, but not limited to, negligence) or otherwise) exceed the amount paid by you,
if any, for accessing this site.
